  • Ottawa Center for the Art's Content: All content on the Site, including but not limited to text, images, graphics, logos, videos, software, and the compilation thereof, is the property of the Ottawa Center for the Arts or its content suppliers and is protected by copyright, trademark, and other intellectual property laws of the United States and the State of Illinois.

  • Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial, informational, and educational use only, subject to these Terms. You may download or print a single copy of the Content solely for your personal use, provided you maintain all copyright and other proprietary notices contained in the Content.

  • Restrictions: You agree not to modify, reproduce, distribute, publish, display, perform, or create derivative works from any Content without the Ottawa Center for the Art's express prior written consent. The Ottawa Center for the Arts' name, logo, and all related names, trademarks, and service marks are the property of the Ottawa Center for the Arts and may not be used without prior written permission.

  • Artist/Exhibited Works: The copyright for all images of artwork displayed on the Site rests with the respective artists, estates, or rights holders. The Center is authorized to display these images, but you must contact the rights holders directly for any reproduction or reuse.

3. User Conduct and Restrictions

  • Upload, post, or transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.

  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

  • Engage in commercial activities of any kind, including advertising or solicitation, without the Ottawa Center for the Arts’ express written consent.

  • Attempt to gain unauthorized access to any portion of the Site, or any other systems or networks connected to the Site.

  • Use any automated means, such as robots, spiders, or similar data gathering and extraction tools, to access, query, or otherwise collect information from the Site.

4. Ticketing, Events, and Donations

  • Purchases: All ticket sales, event registrations, and donations made through the Site or through linked third-party vendors (e.g., ticketing platforms) are subject to that vendor's terms and conditions in addition to these Terms.

  • Accuracy: We strive for accuracy in all event descriptions and pricing; however, we do not warrant that all content on the Site is error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

  • Refunds/Cancellations: All policies regarding ticket refunds, exchanges, and event cancellations are posted on the relevant event page or the ticketing vendor’s site. Unless otherwise stated, ticket sales and donations are final and non-refundable.

5. Links to Third-Party Websites

The Site may contain links to third-party websites or services (such as ticketing agents, payment processors, artists’ personal sites, and social media). We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your use of any third-party website is at your own risk.

6. Disclaimer of Warranties

The Site and all content, materials, information, and services included on or otherwise made available to you through the Site are provided by the Ottawa Center for the Arts on an "AS IS" and "AS AVAILABLE" basis.

7. Limitation of Liability

THE OTTAWA CENTER FOR THE ARTS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE OR FROM ANY INFORMATION, CONTENT, MATERIALS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

You agree to indemnify, defend, and hold harmless the Ottawa Center for the Arts, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or relating to your violation of these Terms or your use of the Site.

9. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

You agree that any legal action or proceeding relating to the Site shall be brought exclusively in the courts located in LaSalle County, Illinois, or the federal courts in the Northern District of Illinois.
